الملخص
يطرح الحق في البيئة إشكالات عالمية في غاية الأهمية، تتمحور حول ضمان حقوق الأجيال القادمة والتأكيد على الاستغلال العقلاني الرشيد للموارد البيئية باعتبارها تراثا مشتركا للإنسانية. وتأتي هذه الدراسة لتعالج المقاربة التنموية كإستراتيجية جديدة تحترم الحدود الايكولوجية وتضمن إلى حدَ بعيد حماية الحق في البيئة، بالنظر إلى دورها المحوري في تحقيق النمو الاقتصادي. وهذا من خلال توسيع وتحديث مفهوم التنمية ليشمل ضرورة التمتع بجميع حقوق الإنسان، خاصة وان التعديل الدستوري 2020 ربط بين حق المواطن في بيئة سليمة والتنمية المستدامة. وطالما أن البيئة هي الوعاء الذي يمارس فيه الإنسان جميع حقوقه الأساسية، فان مقاربة التنمية القائمة على منهج حقوق الإنسان بالضرورة تؤكد الحماية للحق في البيئة. وسيتم التركيز في هذه الورقة البحثية على البعد البيئي في التنمية ومفهوم الاستدامة، وإستراتيجية التمكين من حقوق الإنسان لحماية الحق في البيئة، لنصل إلى التنمية الإنسانية المستدامة كإستراتيجية جديدة لتحقيق الأمن البيئي الضامن للحق في البيئة. The right to the environment raises very important global problems, centered around ensuring of future generations and emphasizing the rational and rational exploitation of environmental resources as the common heritage of humanity. This study comes to deal with the development approach as a new strategy that respects the ecological boundaries and ensures to a large extent the protection of the right to the environment, given its pivotal role in achieving economic growth. This is through expanding and updating the concept of development to include the need enjoy all human rights, especially since the 2020 constitutional amendment linked the citizen s right to a healthy environment and sustainable development. As long as the environment is the vessel in which a person exercises all his basic rights, The development approach based on the human rights approach necessarily emphasizes the protection of the right to the environment. The focus of this research paper will be on the environmental dimension in development, the concept of sustainability, and the strategy for enabling human rights to protect the environment, in order to reach sustainable human development as a new strategy to achieve environmental security that guarantees the right to the environment
