آثارالانسحاب بالإرادة المنفردة من المعاهدة الدولية

الملخص
تعتبر المعاهدة الدولية كاتفاق دولي ذو هدف وغاية ومصلحة دولية يخضع لإجراءات إبرام ولمدة سريان قد تحدد منذ البداية وقد لا تحدد،وانقضاء المعاهدة قد يتم بأسباب عامة اتفاقية أو أسباب خاصة استثنائية تجعلها منتهية بعد تحقيقها لكامل أهدافها أو قبل أن تحقق الغاية المبتغاة من إبرامها، ويعتبر الانسحاب من المعاهدة الدولية بالإرادة المنفردة لأحد أطرافها دون باقي الأطراف من أسباب الانقضاء الواردة الحدوث والذي تناولته الأعراف والقوانين ونصت عليه اتفاقية فيينا للمعاهدات لعام 1969، بماله من نظام قانوني خاص به وضوابط تختلف باختلاف حالة النص عليه في المعاهدة محل الانسحاب أو عدم النص عليه كحق قانوني للأطراف. الأمر الذي قد يخلف آثارا على الطرف المنسحب وعلى باقي الأطراف بالمعاهدة هذه الحالة القانونية التي شهدها واقع العلاقات الدولية في مواقف كثيرة لعل أهمها في العصر الحديث حالة انسحاب بريطانيا من الاتحاد الأوروبي بجميع مراحلها ومن خلال تطبيقها لقانون المعاهدات وبتأثيرها على الأطراف قبل و بعد نفاذ هذا الخروج على المستوى السياسي و الأمني و الإقتصادي والقانوني The international convention is an international agreement with international goal, aim, and interest bound to procedures and a duration that can be defined since the beginning or undefined and to ending procedures that may differ .The convention end may be due to general causes or exceptional specific causes that cancel it either after achieving all its goals or before reaching the set objectives. Some consider withdrawing from an international convention with the one-side will without the others’ as a probable cause of the end that has been tackled by the norms and laws and in Vienna Agreement on conventions in 1969 with its special legal system and the regulations that differ according to what is provided for in the convention to be withdrawn from, or not Provided for as a legal right for the sides. This may trigger many effects on the with drawer and the other sides of the convention. This legal case has been witnessed in many international relationships on many occasions such as Brexit with all its phases and application of the convention law and its impact on the sides before and after the implementation of the withdrawal on the economic, political, security, and legal levels
