أثر تطبيق التوارث الدولي في المعاهدات الدولية

الملخص
هذه الدراسة أثر تطبيق مبدأ التوراث الدولي في المعاهدات كلما طرأ تغيير في تكوين الدولة الإقليمي سواء بإنتقال جزء من الإقليم أو حالة الدولة حديثة الإستقلال أو حالة الإتحاد الدول أو إنفصالها، وهذا من خلال معرفة مصير الإلتزامات والحقوق الدولية التي كانت تلتزم وتتمتع بها الدولة السلف، أي البحث في مدى إلتزام الدولة الخلف بهذه الإلتزامات. وقد تم التطرق لهذه الحالات في ظل إتفاقية فيينا لعام 1978 لخلافة الدول في المعاهدات الدولية. وقد توصلت هذه الدراسة إلى عدة إستنتاجات أهمها أنَّ أثر التوارث الدولي في المعاهدات الدولية يعتبر من المواضيع المهمة والمعقدة في القانون الدولي خصوصا في ظل التطورات المتسارعة والتقلبات التي تشهدها الساحة الدولية والتي ترتبط بهذا الموضوع. الكلمات المفتاحية : المعاهدات الدولية؛ التوارث الدولي؛ الإستخلاف الدولي؛ الدولة السلف؛ الدولة الخلف؛ إنتقال الإقليم؛ الإستقلال؛ الإتحاد؛ الإنفصال. This study examined the effect of applying the principle of international inheritance in international treaties, whenever there is a change in the composition of the regional state, whether by the transfer of part of the territory, the case of the newly independent statue , or the case of the union of states or their secession, and this by knowing the fate of international obligations and rights that were committed and enjoyed by the predecessor state. In other words, researching in wich extent which the successor state is committed to these obligations. These cases were studied according to the Vienna Convention of 1978 to success oral states in international treaties. This study has reached several conclusions, the most important of which is that the impact of international inheritance under international treaties is considered as one of the important and complex topics in international law, especially in light of the rapid développements, taking place in the international space, which are related to this subject.
