المواءمة بين مكافحة ظاهرة الهجرة غير الشرعية وحماية حقوق المهاجرين غير الشرعيين

الملخص
الملخص باللغة العربية: تعد ظاهرة الهجرة غير الشرعية من الظواهر التي أنهكت حكومات الدول في اتخاذ التدابير والاستراتيجيات من أجل مكافحتها والحد من آثارها الاقتصادية والاجتماعية والسياسية والصحية والأمنية، فطبيعة الظاهرة وسرعة تفشيها في أوساط مختلف المجتمعات أدى إلى ظهور جرائم خطيرة مثل : الاتجار بالبشر والإرهاب ...وغير ذلك. لذلك تكافلت الجهود الدولية والوطنية لمكافحة هذه الظاهرة، غير أنه لم تعد تقتصر هذه الجهود على قضايا الهجرة غير الشرعية فحسب، بل وصل الأمر إلى مسألة ضمان حقوق المهاجرين غير الشرعيين وتأدية واجباتهم كأجانب، لكن مشكلة إدماجهم في المجتمعات الرافضة لهم يُعَـدّ مشكلة أخرى، ويعزى ذلك إلى التباين في الدين واللغة والعادات والثقافة . لذلك حاولنا من خلال هذه الدراسة التعرض لنقطة مهمة، وهي مدى الموازنة والتوفيق بين مكافحة الظاهرة وما يقابلها من ضمان حقوق المهاجرين غير الشرعيين . الكلمات المفتاحية : المواءمة ، الهجرة غير الشرعية ، المكافحة ، ضمان حقوق المهاجرين غير الشرعيين . Abstrac Illegal immigration is one of the phenomena that exhausted many governments in taking measures and strategies against it and diminish its economic, social, political, health and security effects. The nature of this phenomenon and the speed of its spread among various societies led to the emergence of serious crimes such as: human trafficking, terrorism...etc. Therefore, international and national efforts have joined forces to fight the phenomenon, however these efforts are no longer limited to issues of illegal immigration only, but the matter goes beyond the issue of guaranteeing the rights of the illegal immigrants and performing their duties as foreigners. Yet again, the problem of integrating them into societies that reject them is another proplem per se, whereby, it is because of variation in religion, language, customs and culture. Accordingly, the study at hand attempts to address the balance and reconciliation between combating the phenomenon in return for ensuring the rights of illegal immigrants.
