الخروج عن القواعد العامة لأسباب انقضاء عقد المقاولة من الباطن

الملخص
قد تحدث لعقد المقاولة من الباطن أسباب معينة، تجعله غير قابل للاستمرار. فقد ينتهي قبل تنفيذ الطرفين لالتزاماتهما ولأسباب تعود للمقاول الأصلي تؤدي إلى إنهاء العقد بطريق غير الطريق الطبيعي لإنهاء هذا العقد. كما قد ينتهي عقد المقاولة من الباطن لأسباب خاصة، ولكن ترجع إلى المقاول الفرعي نفسه وليس للمقاول الأصلي فيكون هذا الأخير مستعدا لتنفيذ التزاماته المترتبة عن هذا العقد، إلاّ أن المقاول الفرعي قد يتعذّر عليه مواصلة تنفيذ التزاماته؛ ففي أثناء تنفيذه العقد قد يموت المقاول الفرعي وينتهي بذلك عقد المقاولة من الباطن ولاسيما إذا كانت شخصية هذا الأخير محل اعتبار في العقد ولا يمكن لورثته تنفيذ التزاماته من بعده. وقد لا يموت المقاول الفرعي إلاّ أنه قد يتعرّض لحادث أو يصاب بمرض يُقعده عن العمل فيصبح عاجزا عن إتمام العمل المعقود عليه. Abstract Subcontracting may occur for certain reasons that make it unsustainable. It may end earlier thanthe two parties carry out their obligations and for reasons attributable to the original contractor leading to termination of the contract by way other than the natural way of terminating the contract. The subcontract Contract may also terminate for special reasonsthat return to the subcontractor himself and not to the original Contractor, the latter being prepared to perform his obligations under this Contract, except that the subcontractor may be unable to continue performing hisobligations.During the execution of the contract thesub-sectioncontractor may die and the sub-section contract ends, especially if the latter's personality is well-thought-out in the contract and his heirs cannot fulfill his obligations thereafter. The sub-section contractor may not die, but he may be exposed to an accident or a disease that leaves him unable to complete the held on work.
