الفقه المذهبي بين مسوغات التقيد وموجبات التجدد

الملخص
البحث هو محاولة بيان إلى أي مدى يمكن الالتزام بالفقه المذهبي، وكيف يمكن ترشيد التعامل مع المذاهب الفقهية بعيداً عن مسلكي الإفراط والتفريط، أما الإفراط في التمذهب إلى حد التعصب، فيحجبنا عن الحق ، ويوقعنا في الجمود، وأما التفريط فيه إلى حد رده بالكلية، فيمنعنا من الاستفادة من المذاهب الفقهية، ويحرمنا من ثروة فقهية غنية تكونت عبر فترات زمنية طويلة وتعاقب عليها عدد كبير من الفقهاء، فحاولت من خلال هذا المنهج الوسط في التعامل مع التمذهب، أن أُبيِّن محاسن وفوائد الالتزام بالفقه المذهبي بعيداً عن التعصب المقيت، لخدمته والاستفادة منه، مع ضرروة التجديد إذا وجدت مبرراته، وقامت موجباته، وبهذا يحقق الفقه الإسلامي غايته، ويسجل حضوره في حياة الناس، ويكون عونا لهم على الالتزام بشريعة الله تعالى، ورفع الحرج عنهم. Summary: The research is an attempt to show the extent to which it is possible to adhere to doctrinal jurisprudence And how can we rationalize dealing with the jurisprudential schools away from the excesses and negligence. The excessive devotion to the point of fanaticism, it prevents us from the truth . It gets us stalemate . As for neglecting it to the extent of a response to the college, It prevents us from benefiting from the doctrines of jurisprudence. It deprives us of a rich doctrinal wealth that was created over long periods of time and has been alternated by a large number of schollars . So, I tried, this moderate approach to show the advantages, merits and benefits of adhering to doctrinal jurisprudence, away from detestable fanaticism in order to serve it and benefit from it, with the necessity of renewal if its justifications were found and its obligations were carriedout . In this way, Islamic jurisprudence achieves its goal and records its presence in people's lives . It will be a help to them to adhere to the law of God Almighty and relieve embarrassment from them .
