التنظيم القانوني للسلطة الوطنية المستقلة للانتخابات بالجزائر. "بين متطلبات الاستقلالية وموجبات الفعلية"

الملخص
لما كانت الغاية التي تصبو القوانين الانتخابية تحقيقها هو الوصول لانتخابات حرة، شفافة ونزيهة عبر جميع محطات ومراحل العملية الانتخابية، بحيث تكون منسجمة مع المعايير العالمية المستخلصة من التجارب الديمقراطية الرائدة، يصبح من الأهمية بمكان التركيز على أبرز تلك المعايير، والمتمثل في استقلالية الادارة المكلفة بالإشراف والرقابة على الانتخابات في جانبيها العضوي والوظيفي بما تنعكس ثماره لزوما على صحة ومصداقية العملية الانتخابية في جميع مراحلها. والجزائر كغيرها من الدول حرصت على تكريس استقلالية الإدارة الانتخابية بشكل صريح منذ التعديل الدستوري لسنة 2020 والذي تكفل بدسترة السلطة الوطنية المستقلة للانتخابات وترتيبها ضمن الباب الرابع المتعلق بمؤسسات الرقابة، ثم جاء تفصيل أحكامها ضمن القانون العضوي للانتخابات. وتهدف هاته الورقة البحثية الى دراسة وتبيان مدى فعلية وفعالية الاطار القانوني الناظم للسلطة الوطنية للانتخابات في تنظيم وإدارة وتسيير دواليب العملية الانتخابية. Since the goal that electoral laws aspire to achieve is to achieve free, transparent and fair elections across all stages and stages of the electoral process, so that they are consistent with international standards derived from pioneering democratic experiences, it becomes important to focus on the most prominent of these standards, which is the independence of the administration charged with supervision. Monitoring elections in both its organic and functional aspects Its results inevitably reflect on the validity of the electoral process at all its stages. Algeria, like other countries, has been keen to explicitly establish the independence of the electoral administration since the constitutional amendment of 2020, which guaranteed the constitutionalization of the Independent National Authority for Elections and its arrangement within Chapter Four related to oversight institutions, and then its provisions were detailed within the organic law for elections. This research paper aims to study and demonstrate the effectiveness and effectiveness of the legal framework regulating the National Elections Authority in organizing, managing the electoral process.
