الملخص
للدفتر العقاري في النظام القانوني الجزائري أهمية بالغة الأثر، فهو السند الوحيد لإثبات الملكية العقارية، وهو نسخة عن البطاقة العقارية التي تشكل مجموعها السجل العقاري، وهو التنظيم الجديد للملكية العقارية الذي تبناه المشرع الجزائري بهدف ضبط حق الملكية العقارية وإقراره وحمايته وفق التنظيم العقاري الحديث، وهو ما يجعل موضوع الدراسة حديثا نسبيا، مما أسال الكثير من الحبر حول معرفة هذا النظام والمنازعات التي تنشأ بصدده والآثار المترتبة عليها، وأخص بالدراسة في هذا المقال الدفتر العقاري من حيث ماهيته وإلغائه والآثار المترتبة على ذلك. The real estate book in the Algerian legal system has a very influential importance, as it is the only document for proof of real estate ownership, and it is a copy of the real estate card that makes up the real estate registry, and it is the new regulation of real estate ownership adopted by the Algerian legislator with the aim of controlling, approving and protecting the right of real property in accordance with modern real estate regulation, Which makes the subject of study relatively recent, which asked a lot of ink about knowledge of this system and the disputes that arise in connection with it and the implications thereof, and I particularly study in this article the real estate book in terms of its essence, its cancellation and the implications thereof.
