التنازل عن الأوعية العقارية كتحفيز لإنجاز البرامج السكنية المدعمة

الملخص
ملخص: إن بعث المشاريع السكنية من أجل مجابهة أزمة السكن يتطلب توفير العديد من المتطلبات، ومن بينها تنويع الصيغ السكنية لاستقطاب كل شرائح المجتمع، ومن بين أهم هذه الصيغ نجد مشاريع السكن الترقوي المدعم التي أوكلت مهمة إنجازها إلى المرقين العقاريين سواء العموميين أو الخواص. لاشك أن هذه المشاريع تتطلب تدخل الدولة من أجل توفير الأوعية العقارية التي تستوعب مثل هذه المشاريع، في ظل ندرة العقار القابل للتعمير خاصة على مشارف المدن الكبرى. وقصد جلب المرقين العقاريين للمساهمة في إنجاز مشاريع السكن الترقوي المدعم، لجأ المشرع الجزائري إلى تحفيزهم عن طريق سن قوانين تسمح للدولة بالتنازل لهم عن الأوعية العقارية المستقبلة لهذه المشاريع مقابل مبالغ مالية رمزية، وفي مقابل ذلك يتعهد المرقي العقاري بتخصيصها لما خصصت له دون تغيير وجهتها، وذلك وفق آليات مقننة وشروط محكمة لضمان إنجاز هذه المشاريع على أرض الواقع. كلمات مفتاحية: الأوعية العقارية، الترقية العقارية، التنازل على العقار، السكن المدعم، الأملاك الوطنية. Abstract: The revival of housing projects in order to confront the housing crisis requires the provision of many requirements, among them the diversification of housing formulas to attract all segments of society, and among the most important of these formulas we find promotional housing projects that are implemented by real estate promoters, whether public or private. There is no doubt that these projects require the intervention of the state in order to provide real estate containers that accommodate such projects, in light of the scarcity of real estate that can be constructed, especially on the outskirts of major cities. With the intention of bringing real estate promoters to contribute to the realization of subsidized housing projects, the Algerian legislator resorted to motivating them by enacting laws that allow the state to assign them to the real estate containers receiving these projects in exchange for symbolic sums of money, and in return for that the real estate promoter pledges to allocate them to what they were allocated without changing their destination, And that is in accordance with codified mechanisms and tight conditions to ensure the completion of these projects on the ground.
