الرّدّ بالعيب في التّجارات الحديثة عيوب السّيّارات نموذجا

الملخص
إنّ الشّريعة الإسلاميّة جاءت لتنظيم علاقات العباد مع خالقهم، وعلاقاتهم فيما بينهم، وهي شريعة كاملة من كلّ وجه، خالية من كلّ نقص، جاهزة لكلّ متغيّرات الحياة، ومع تطوّر الصّناعات من مراكب ووسائل للنّقل وغيرها من التّكنولوجيا الحديثة، يحتاج النّاس إلى بيان أحكام هذه المعاملات، فكان هذا البحث لبيان الأحكام الفقهيّة لعيوب السّيّارات من الرّدّ أو التّعويض عن النّقص النّاجم عن تلك العيوب، بين البائع والمشتري؛ حتّى يقام العدل في الأرض، ويأخذ كلّ ذي حقّ حقّه، وقد بنى الباحث دراسته على دراسة نظريّة لكلام الفقهاء، مع استشارة ميكانيكي وتاجر في السّيّارات، بالإضافة إلى تجربة شخصيّة ميدانيّة في بيع وشراء بعض السّيّارات. وقد خلص الباحث إلى انقسامها إلى ثلاثة أنواع، عيب خفيف لا يؤثر على البيع، لأنه لا ينقص من الثّمن، وعيب القيمة وهو اليسير الّذي ينقص من الثّمن، فيَحُطُّ عن المُشتري من الثّمن بقدر نقص العيب، وعيب فيه الرّد وهو الفاحش الّذي ينقص حظًّا معتبرا من الثّمن. Abstract: The Islamic Canon has come to organise the relation of people with their creator and with each other, it's a full canon of all sides with no default, ready to adapt to all life's change. With the development of industries, vehicles and other modern technologies, people need a clarification of the provisions of these dealings, this research came to clarify the jurisprudential provisions for these defects either by giving back or redeeming for the bad performance because if these defects, between sellers and purchasers to realise justice in the world, and everyone takes his right. The researcher founded his research on a theoretical study of the jurisprudence's view, in addition to consulting a mechanic and car concessionary beside a practical personal experience in selling and buying cars. The researcher has deduced that it's devided into three kinds, a soft default that doesn't influence the sale contract, because it doesn't reduce the price, and value default which decrease the price, the client benefits of a reduction that equals the default, and a serious default that which reduces the big part of its price .
