الخلفيات المذهبية الفقهية وأثرها في فهم النص القرآني -دراسة تأصيلية تطبيقية-

الملخص
ملخص المقال: يتضمن هذا المقال دراسة لقضية مهمة في التفسير وهي أثر الانتماء الفقهي للمفسر في تفسيره لآي القرآن الكريم، حيث تعرضت فيه لجانبين من جوانب هذه القضية، أحدهما: نظري، وهو معنى الاتجاه الفقهي في التفسير و نشأته وأهم المؤلفات فيه والتي كان فيها الحظ الأوفر للمذهب المالكي، كما بيّنت أهم أسباب اختلاف المفسرين في تفسير آيات الأحكام وأثر أصول المذهب في الاختلاف . وبعدها قمت بتتبع مجموعة من أبرز آيات الأحكام التي كثر فيها الخلاف عند مجموعة من المفسرين ينتمون لمذاهب فقهية مختلفة، وتتبعت اختياراتهم فيها . لأخلص في الأخير إلى أن الخلفية الفقهية كان لها أثر بالغ في تفسير آيات الأحكام، حيث إننا نجد أن الآية الواحدة يستدل بها أصحاب المذاهب الأربعة على مذهبهم من أوجه استدلال مختلفة وإن كان بينهم اختلاف تضاد، غير أن منهم من كان متعصبا يتكلف الاستدلال على مذهبه بالآية ولو لم تحتمله، ومنهم من كان معتدلا في استدلالاته . Abstract: This article includes a study of an important issue in the interpretation it is the effect of the idiosyncratic affiliation of the interpreter in his interpretation of the quranic verses. I dealt with sides or aspects of this issa, one is the article which is the meaning of the juristic trend in interpretation, its emergence and its important publications. And it was the fortune of the Maliki school. I also showed the main reason of the difference between the interpreters when interpreting the verses of provisions and the effect of the origins of the doctrine on the difference. Then i went through of the most prominent verses of provisions which contain a lot of disagreement amoug a group of interpreters belonging to different doctrines and i followed their choices . To sum up at the end that the juristic background had a great impact on the interpretation of the verses of provisions since the same verse may be used the four doctrines even if they have an antibody difference. However some of them were bigoted and constrain themselves to infer with the verse even though it doesn't fit.Whereas some others are moderate in their inference.
