منهج ابن العربي في استدراكاته على الفقهاء

الملخص
يهدف هذا البحث إلى بيان حقيقة الاستدراك الفقهي، وإيضاح مثاراته وأغراضه، كما يعني باستجلاء استدراكات الإمام ابن العربي الفقهية، وإبراز سمات ومقومات منهجه فيها. وقد استوى ذلك في مقدمة، ومبحثين، وخاتمة؛ المبحث الأول: الاستدراك الفقهي ( تعريفه، ومثاراته، وأغراضه)، المبحث الثاني: سمات ومقومات منهج ابن العربي في استدراكاته الفقهية، وختم البحث بخاتمة، ثم توصلت إلى عدة نتائج منها: • أنّ الاستدراك الفقهي لا يلجأ إليه إلاّ إذا لجّت مثاراته، وتوافرت دواعيه. • من منهج ابن العربي في استدراكاته الردّ بالأصول النقلية والعقلية، وتحكيم القواعد الشرعية. In this research I will aim to clarify the true essence of jurisprudential redress, its causes and purposes. In addition, it aims at clarifying the principles that Ibn Alarabi used to form his opinions and its traits. My research is divided into an introduction, main body (divided into two parts) and a conclusion. The first part of the main body is about the jurisprudential redress (its definition, causes and purpose). The second part is about the traits and principles the scholar Ibn Al Arabi’s built his jurisprudential redresses on. And ended with a conclusion. Through my research, I have reached the following conclusions; • We only use Jurisprudential redress in the presence of its causes. • The method of Ibn alarabi includes using textbooks and sound reasoning in addition to the dependence on Islamic rulings.
