الملخص
يهدف البحث الموسوم باسم (اختلاف المناطات الخاصة وأثرها في تحول المباح عن مقتضاه) إلى بيان استجلاء فكرة هذا التحول بالنظر إلى مفهومه وبيان التوافق بين الجزئية والكلية في الأحكام الشرعية الخمسة. وتكمن أهمية دراسة هذا الموضوع في أنه يتصل بمباحث الأحكام الشرعية التي تعدّ دراستها من أوجب الواجبات، وكذلك التأكيد على أنّ المباح ليس مباح التناول بإطلاق ولا مباح الترك بإطلاق، وأن التكاليف الشرعية مبنية على مراعاة المصالح والحكم والمقاصد الشرعية. سار البحث وفق منهجَيّ الاستقراء والتحليل ثم خلص إلى نتائج أهمها: أن معنى تحول المباح عن مقتضاه هو: (تغير حكم المباح عن أصله إلى غيره من الأحكام التكليفية الأربعة الأخرى لمسوغ وفق ضوابط معينة عملاً بالقواعد والأدلة الأصولية). وأن الشريعة وضعت لإحقاق الحقوق ورفع الظلم، والموازنة بين الأمور، وأن الموازنة بين الكليات والجزئيات من أهم العمليات الاجتهادية في تحقيق المناطات. وأن علاقة تحول المباح عن مقتضاه بتحقيق المناط الخاص تكمن في رعاية الخصوصيات وتفنيد التحايلات وإبقاء عجلة الاجتهاد سائرة. The research entitled "The Differences in Specific Rulings and their Impact on the Transformation of Permissible Acts" aims to clarify the concept of a permissible act that is transformed from its original ruling, taking into account its definition and the compatibility between the specific and general rulings of the five Islamic legal principles. The significance of studying this topic lies in its connection to the study of Islamic legal principles, which is one of the most important duties. Furthermore, it emphasizes that permissibility does not mean unrestricted consumption or abandonment, and that Islamic legal obligations are based on considering interests, rulings, and objectives. The research followed the methods of induction and analysis and reached several conclusions, the most important of which are: The meaning of transforming a permissible act from its original ruling is changing its ruling to one of the other four legal obligations, subject to specific rules and evidence based on Islamic principles. This Sharia was established to protect rights, eliminate injustice, and balance between Balancing between general and specific rulings is one of the most important methods of legal reasoning. The relationship between transforming a permissible act from its original ruling and achieving specific rulings lies in: protecting specific rights, refuting manipulation, and keeping legal reasoning active.
