إساءة استخدام الأنترنت في القانون الجزائري

الملخص
الملخص: إن شبكة الأنترنت توفر طرقا حديثة للتواصل، لكنها توفر كذلك مجالا خصبا للجرائم الحديثة التي أصبحت تنخر المجتمع وتهدده في كيانه وفي كيان الأسرة بل ويتعداه إلى تهديد كيان الدول وتوتر العلاقات الدولية وتهديد أكبر الشركات الاقتصادية والتجارية العالمية بالإفلاس. فتتعدد صور الأفعال المجرمة التي ترتكب بواسطة وسائل الأنترنت بحيث نجد الإختراق والدخول والبقاء بدون إذن وعدة أفعال أخرى تشكّل أركانا لجرائم معلوماتية الأمر الذي جعل التشريعات المختلفة ومنها المشرع الجزائري يسعون نحو ايجاد سياسة جزائية تسمح بردع المرتكبين والحد من توسع هذا النوع من الإجرام. Abstract: Crime is an anti-social activity that has been known since the emergence of mankind, but it developed with its development, whether in the persons who committed it or in the method of its commission, so that criminals began to search for ways to develop means of committing crime by using the latest knowledge and adapting it to serve the crime. The emergence of the computer and the innovations related to it that developed and expanded its uses, such as the information network and information systems, had a clear impact in the criminal field, so that the information system provided the opportunity to commit traditional crimes in unconventional ways, thus a new environment created for crime and criminal behavior was completely different. An example of the topics raised by modern technologies is the issue of human rights and fundamental freedoms, which the technological stage allows its ill-intentioned users to violate and abuse. It became imperative for the legal texts to be compatible with modern methods of committing the crime, which called for the legislator in the field of confronting electronic crime to issue special texts, whether in the field of criminalization or in the field of confrontation by means of criminal procedures, since the specificity of this technical crime requires, as well as legal expertise.
