التزام الوكيل بالعمولة بضمان سلامة نقل الأشخاص

الملخص
يتمتع الوكيل بالعمولة لنقل الأشخاص بحرية واسعة في تنظيم عملية النقل؛ نظرا لخبراته ومهاراته في هذا الميدان، فيلتزم بالإضافة إلى إيصال المسافر إلى المكان المتفق عليه، بضمان سلامته، سواء نفذ الالتزام بنفسه باستخدام وسائله الخاصة، أو بواسطة غيره من الناقلين مقابل أجرة أو عمولة، وبذلك فهو ملزم بتحقيق نتيجة وهي المحافظة على سلامة الراكب وعدم المساس بها طيلة مدة تنفيذ العقد، وإذا أخل بها تقوم مسؤوليته بالتعويض عن الأضرار التي لحقت موكله، ولا يجوز اعفاؤُه من المسؤولية إلا إذا ثبت أن ذلك الضرر يعود إلى وجود سبب أجنبي خارج عن إرادته، يتمثل إما في وجود القوة القاهرة أو خطأ المسافر أو فعل الغير.
