آثار مبدأ الثبات التشريعي على عقود استثمار البترول

ملخص: بغية المساهمة في دفع عجلة التنمية الاقتصادية والاجتماعية للبلاد، تسعى الدولة إلى تشجيع الاستثمارات الأجنبية من خلال توفير مناخ استثماري ملائم، عن طريق منح مجموعة من الضمانات والتحفيزات للمستثمرين الأجانب فنجد من بين هاته الضمانات مبدأ الثبات التشريعي، الذي يعد من أهم العوامل المساهمة في استقطاب الاستثمارات الأجنبية خاصة ما تعلق منها بعقود استثمار البترول التي تتميز بطبيعتها المعقدة والخطيرة وطول مدة تنفيذها. فمبدأ الثبات التشريعي يعتبر وسيلة هامة للحد من المخاطر الناتجة عن عدم الاستقرار التشريعي خاصة في الدول النامية، حيث تكمن أهميته في عقود استثمار البترول بتحقيق التوازن العقدي والأمان القانوني الذي يبحث عنه المستثمر من خلال تعهد الدولة بعدم تطبيق أي قانون جديد على عقود استثمار البترول، سواء بالنص على هذا الشرط في قانون استثمار الدولة المضيفة أو في عقد استثمار البترول. Abstract : In order to contribute the economic and social development of the country, the State seeks to encourage foreign investment by providing a favorable investment climate, by granting a range of guarantees and incentives to foreign investors. We find among these guarantees the principle of legislative stability, which is one of the most important contributing factors to attracting foreign investment, especially those related to oil investment contracts characterized by their complex and dangerous nature and the length of their implementation. He principle of legislative stability is an important means of reducing the risks resulting from legislative instability, especially in developing countries, where its importance lies in oil investment contracts by achieving the contractual balance and legal security that the investor is looking for, through the State's commitment not to apply any new law to oil investment contracts, either by stipulating this requirement in the host country investment law or in the oil investment contract.
