الملخص
يهدف هذا المقال إلى تبيان صفات المحامي الجزائري في كل من القانون والشرع الإسلامي، حيث تتجلى هذه الصفات في حماية حقوق المواطن والدفاع عنها أمام القضاء، وتكريس سيادة القانون، لذلك فالمحامي مسؤول على احترام الإجراءات الدفاعية للقضايا والمسائل وتطبيق القانون، ولا يحصل ذلك إلا بقواعد تحدد مهام وصفات وأخلاقيات المحامي لأنه سفير الحق للقضاء من جهة، ووفقاً للقيم والمبادئ الإسلامية التي يجب التحلي بها واحترامها. وعليه فخلص المقال إلى ضرورة إعادة المشرع الجزائري النظر إلى القانون الخاص بالمحامين؛ والذي يضمن الأخلاق السامية في هذه المهمة النبيلة، بحيث لا تحرف القواعد القانونية ولا تعدل إلا عند الضرورة الداعية، أو عند التأثر بأزمة استثنائية – مثل أزمة فيروس كورونا 19-، أو عند استحداث منظومة قانونية تنموية، تهدف إلى ضمان عملهم بشكل مستقل وبدون عوائق، وفق معايير مستجدة وأخلاقيات مستحدثة بمنهجية إسلامية ذات مصدر إسلامي (القرآن الكريم والسنة المحمدية) وأقوال السلف الصالح. This article aims to address the qualities of the Algerian lawyer in both the law and Islamic Sharia, which are represented in the qualities in protecting and defending the rights of the citizen before the judiciary, and consecrating the rule of law, because he is responsible for respecting legal procedures and legal solution to issues and problems, and this does not happen except by rules that define The duties and ethics of the lawyer, because he is the ambassador of the right to the judiciary, and for the lawyer to be characterized by Islamic principles. In sum, the need for the legislator to re-theorize the law on lawyers; It guarantees ethics in the exercise of this noble task, and limits obstacles when necessary, or the emergence of an exceptional crisis - the Corona 19 crisis-, or when a new legal system is modern, aims to ensure the attorney’s duties without hindrances, in accordance with indicators and ethics with an Islamic methodology (the Qur’an and Sunnah) and sayings Ancestors.
