جائحة كورونا ومدى تأثيرها على مبدأ العقد شريعة المتعاقدين

الملخص
تقتضي القاعدة " العقد شريعة المتعاقدين" أنه ليس لحد أن يستقل بفسخ العقد أو تعدليه بمفرده، وليس له أن يتحلل بإرادته المنفردة من التزاماته التي تقررت بمقتضى العقد، غير أن هذه القاعدة مشروطة ببقاء الظروف التي تم فيها العقد. ومنه يناقش هذا البحث حالة ظهور جائحة كورونا وكيفية تأثيرها على قاعدة شريعة المتعاقدين التي تؤدي إلى تغيير الظروف التي تم فيها العقد، وصولا إلى ظهور آليتين تعالج هذه الحالة. The ' rule contract law contracting parties' rule requires that it is not until it is independent of the avoidance of the contract or amended on its own, and cannot unilaterally dissociate itself from its obligations established under the contract, but this rule is conditional on the survival of the circumstances in which the contract was concluded. This research discusses the state of the corona pandemic and how it affects the rule of the contracting parties law, which changes the circumstances in which the contract was made, leading to the emergence of two mechanisms that address this situation.
