المبادئ العامة لتحقيق البيئة المستدامة في التشريع الجزائري General Principles For Achieving A Sustainable Environment In The Algerian Legislation

الملخص
عرفت المبادئ الأساسية لحماية البيئة أول مرة في مؤتمر الأرض بريودي جانيرو سنة 1992م، وقد كان لهذا المؤتمر الصدى البالغ حيث أبرمت بعده العديد من الاتفاقيات الدولية مكرسة المبادئ التي تبناها، وجاءت كمزيج بين المبادئ الأساسية والمبادئ القانونية ومستوحاة من فكرة القانون المرن، وسرعان ما انتقلت إلى التشريعات الداخلية للدول، منها التشريع الجزائري، الذي أعاد رسم السياسة البيئية بصدور القانون رقم 03/10 المؤرخ في 19 جويلية 2003م، وهذا بإدراج مبادئ عامة مسايرا بذلك التوجه الدولي الذي يقضي بضرورة حماية البيئة والموازنة بينها وبين التنمية المستدامة، والملاحظ أن المشرع الجزائري أعطى لبعضها قيمة قانونية تعادل القواعد القانونية، واكتفي في البقية بالصيغة الإعلانية التوجيهية فقط دورها استئناسي بالنسبة للقاضي. The first appearance of the basic principles of the environmental protection were at the Rio de Janeiro Earth summit Conference in 1992, and this conference had a great Impact , which many international agreements were concluded with the devoting of the principles that the Rio De Janeiro conference adopted, and came as a mixture between basic principles and legal principles that has been inspired by the idea of the flexible law, and soon it moved to The internal legislation of the countries, including the Algerian legislation, which redefined the environmental policy with the promulgation of Law No. 10/3 of July 19, 2003, by including general principles that get along with the international trend that stipulates the obligation of the protection of the environment and the balance with sustainable development. It is noticeable that the Algerian legislator gave some of them a legal value that is equivalent to legal rules, and for the rest the legislator kept them only with the advertising directive form , and its role is for the inference in the regard of the judge.
