إشكالات تنفيذ العقوبات المالية من تركة المتهم دراسة فقهية إجرائية

الملخص
إن موضوع العقوبات المالية يكتسب أهمية بالغة في المجتمع، إذ أنه ينطوي على المساس بالذمة المالية للمحكوم عليه، ولما كانت الغاية الجوهرية للحكم بها إنما كان لإيلام الجاني، إلا أن مقصد الردع العام والخاص متحقق، ولو اعتبر نسبيا من زمن إلى زمن، كما نجد أن المشرع الجزائري – على غرار معظم التشريعات العقابية- قد سعى إلى الإلمام بكافة المبادئ الحديثة في السياسة العقابية، للنهوض بقطاع العدالة في مجال تنفيذ الأحكام الجزائية، ولا سيما ما تعلق بتنفيذ الغرامة والمصادرة باعتبارهما من العقوبات المالية في التشريعات العقابية الحديثة. إلا أن الإشكالات التي تثيرها مسألة التنفيذ، أبرزت أقلام الباحثين لإيجاد الحلول ووضع المقترحات ضمانا لحسن سير مرفق العدالة، إلا أن مسألة مدى اعتبار الغرامة عقوبة خالصة تسري عليها نتائج انقضاء العقوبة بوفاة المتهم هي التي أثارت النقاش عند بعض التشريعات العقابية التي خلعت وصف العقوبة الخالص منها، بتحولها إلى دين مدني يمكن تنفيذه من التركة، وهذا ما لم يُطرح في التشريع الجزائري، باعتباره قد تمسك بالمبدأ العام القاضي باعتبار الغرامة عقوبة خالصة تسري عليها خاصية الشخصية. Abstract: The issue of financial penalties acquires great importance in society, as it involves prejudice to the financial liability of the convicted person, and since the essential purpose of judging it was for the pain of the perpetrator, yet the purpose of public and private deterrence is achieved, even if it is considered relatively from time to time, as we find that The Algerian legislator - like most penal legislation - has sought to be familiar with all modern principles in penal policy, in order to advance the justice sector in the field of the implementation of penal judgments. However, the problems raised by the issue of implementation highlighted the researchers' pens to find solutions and develop proposals to ensure the proper functioning of the justice facility, but the issue of the extent to which the fine is considered a pure punishment on which the results of the expiry of the sentence are applied by the death of the accused is what sparked discussion in some penal legislation that dislodged the pure description of punishment. By turning it into a civil debt that can be executed from the inheritance, and this is not raised in the Algerian legislation, as it has adhered to the general principle that the fine is a pure punishment that the characteristic of personality applies to it.
