الملخص
ملخص : تقوم الشركات العسكرية والأمنية المتواجدة حول العالم بمهام تعتبر في العديد من الأحيان من صميم العمليات العسكرية أثناء النزاعات المسلحة، وهو ما قد يجعل هذه الشركات وموظفيها في كثير من الأحيان على صلة مباشرة بأشخاص يحميهم القانون الدولي الإنساني، حيث أنّ هذا الإحتكاك والصلة المباشرة بالأشخاص المحميين يمكن أن يؤدي إلى إنتهاكات وتجاوزات ومخالفة القواعد الدولية التي تحمي هؤلاء الأشخاص، ومن أجل ذلك ظهرت الحاجة إلى تكثيف الجهود الدولية لتنظيم أنشطة ومهام هذه الشركات، ومن بين هذه الجهود نجد جهود مجلس حقوق الإنسان التابع لهيئة الأمم المتحدة وهذا من خلال الفريق العامل المعني بمسألة إستخدام المرتزقة كوسيلة لإنتهاك حقوق الإنسان وإعاقة ممارسة حق الشعوب في تقرير المصير، و الفريق العامل الحكومي الدولي المفتوح باب العضوية المعني بتفصيل مضمون إطار تنظيمي دولي يتعلق بأنشطة الشركات العسكرية والأمنية الخاصة. Abstract: The worldwide security and military companies do have duties that are usually derived from the military activities and operations during the different military struggles. And this may make these companies and its employees in a direct touch with some powerful people well protected by the international humanity law. This protection may also give the opportunity to these people to practice some prohibitions, and not to apply the international law. This is why many nations felt needing to progress in thinking about how to organize and limit the military companies tasks and duties. Human right council that’s related by the united nations organization was one of the important staff and bodies concerned by this topic, using mercenaries as a tool infringe human right and violate people right of deciding their social and political future, using also there international governmental team as a tool to give more details about the real tasks and duties of these security and military companies
