آليات الحماية القضائية لبراءة الاختراع في التشريع الجزائري

الملخص
تعتبر براءة الاختراع من قبيل حقوق الملكية الفكرية، والتي تعد أداة لتنفيذ سياسة التطور الاقتصادي والتكنولوجي داخل الدولة، إذ يعترف القانون للمخترع بحق خاص على ابتكاره، فيلتزم كل مالك للاختراع باستغلال هذا الاختراع، وفقا للكيفيات المتاحة قانونا لذلك، مقابل توفير حماية قانونية بموجب البراءة الممنوحة له، خلال المدة المحددة قانونا لها، فخلال هذه المدة يمنع على الغير استعمال أو استغلال هذا الاختراع موضوع الحماية، وإلا كان عرضة للجزاءات المقررة لذلك. فقد أقر المشرع الجزائري للمخترع الحق في رفع دعوى المنافسة غير المشروعة كآلية لحماية حقه في ملكية براءة الاختراع، شرط قيام أركان هذا الحق من خطأ وضرر وعلاقة سببية تجمع بينهما، كما منح المشرع الجزائري لمالك براءة الاختراع إمكانية الدفاع عن حقه في هذه البراءة عن طريق رفع دعوى التقليد على كل من تسول له نفسه تقليد اختراع هذا الأخير، وفقا للمقتضيات المنصوص عليها قانونا. The patent is considered one of the Fields of the intellectual property rights. It is also a tool for fulfillment of the development politics economically and technologically in the country. The law acknowledges the inventor's special right for it. This allows him to exploite his invention according to the available legal ways for the legal protection based on the patent given to him during a period specified legally. During this period of time it is prohibited to use or exploited this invention otherwise it would be liable to penalties. The algerian adjudicator acknowledged that the inventor has the right to raise a lawsuit against illegal competition as a procedure to protect his patent provided having the parts of the parts of that right the fault the harm and the causality relation. In addition the adjudicator afforded the patent inventor the right to defend his possession of this patent by raising a lawsuit against those who dare to imitate that invention according to the law requisites.
