أنظمة الدفع الإلكتروني Electronic Payment Systems

الملخص

أدى التطور التقني واستخدام الحاسب الآلي وشبكة الأنترنت إلى تطور كبير في التعاملات المالية والتجارية حيث دفع هذا الواقع الجديد بالمؤسسات المالية والمصرفية إلى إيجاد أنظمة دفع إلكترونية متنوعة وإيجاد وسائل دفع تكون بديلا للنقود التقليدية ويمكن استخدامها في أي وقت ومن أي مكان، لذلك ظهرت أنظمة الدفع الإلكتروني إلى جانب أنظمة الدفع التقليدي لتتوافق مع طبيعة التصرفات القانونية والعقود التي تتم باستخدام وسائل التقنية الحديثة. غير أن هذا الواقع الجديد في أساليب الدفع والوفاء أثار تساؤلات حول الطبيعة القانونية لهذه الأنظمة وتكييف العلاقات الناشئة بين أطرافها، وحول ما إذا كانت تخضع للقواعد العامة أم لابد من خلق أخرى جديدة تحكمها ؟ يتناول هذا البحث دراسة أنظمة الدفع الإلكتروني الحديثة منها والمطورة من خلال التطرق إلى تعريفها ودراسة طبيعتها القانونية مع ذكر أهم أنواعها. Abstract: The technical development and use of the computer as well as the internet have led to a great development in financial and commercial transactions. Indeed, this new reality has pushed financial institutions and bankers to find new electronic payment systems and find alternative payment methods that replace the traditional currency that can be used anytime and anywhere. This is why new electronic payment systems have appeared with traditional payment systems to be in harmony with the nature of legal behavior and acts that are carried out using modern technical means. Nevertheless, this new reality in payment and reimbursement modes has raised questions about the legal nature of these systems by adapting the arising relations between its parties and, whether they are subject to general rules, or there is a need to create others they govern. This study deals with modern electronic payment systems developed by defining them and studying their legal nature by citing their own types.
