العنف بين الإباحة والتجريم.

الملخص
الملخص: إن الأصل في الأشياء الإباحة ما لم يأت أو يظهر العرف أو النص الذي يحرمها ويجرمها ،ولأن العنف كثيرا ما يسبب أضرارا وكوارث انسانية وبيئية تفوق ما يحققه من فوائد ومكتسبات لمجتمع البشرية، ناهيكم عن أنها – في حال تحققها- تكون مقصورة على فئة ضيقة منه .لذلك نصت معظم القوانين الربانية والوضعية البشرية على نبذه وتجريمه ،إلا ما كان يقوم على الاكراه والضرورة ،كرد العدوان والدفاع الشرعي، والقضاء على العدوان من جذوره والجهاد، والرياضات القائمة أساسا على فعل العنف كالمصارعة والكاراتيه والملاكمة وغيرها ... لذلك سوف تسعى هذه الورقة البحثية إلى محاولة تبين الحكمة من حظر العنف وفوائد ذلك لتنصرف الى التركيز عن الحديث عن العنف المباح الذي هو الاستثناء ومحاولة تبين أهم أشكاله ومبررات إباحته . الكلمات المفتاحية: العنف . الإباحة .التجريم. العرف .النص. Abstract: In their origin, things are allowed as soon as there is no text that prohibits and criminalizes them, except violence that causes damage and humanitarian and environmental disasters beyond what can be realized as benefits and acquisitions for human society and in case of realization of these, they will be limited to a restricted category of individuals. Indeed, the majority of divine and human laws confirmed his repulsion and his criminality except what was based on coercion and the need to deal with aggression, the legitimate defense, the elimination of jihad and the aggression from his roots and sports based mainly on an act of violence such as wrestling, karate, boxing and others ... For this reason, this article tries to show wisdom in banning brutality and the benefits of it to center the discussion on tolerated violence, which is the exception, and to try to show its most and the justifications for its legislation.
