مدى مشروعية السلطة القمعية المخولة للسلطات الادارية المستقلة

الملخص
يرتبط ظهور السلطات الإدارية المستقلة بمتطلبات الحكم الرشيد,من خلال أن إنشائها والاعتراف بها يعكس تنامي الديمقراطية في المجتمع لأنها تقوم أساسا على وجود هيئات تعمل خارج السيطرة الحكومية, متمتعة بضمانات يمنحها إياها نظامها الأساسي وصلاحيات تسمح لها بأداء مهامها ,مع تخلصها من رقابة السلطة التنفيذية التدرجية و الوصائية. ومع ذلك فليس سهلا دائما تكييف الوضعية والطبيعة القانونيتين لهذه الهيئات, التي تمارس سلطة إدارية معتبرة في قطاعات نشاط معينة مما حدا ببعض الشرّاح إلى القول عنها بأنها تشكل بذاتها تناقضًا داخل التقاليد السياسية، من حيث أن الإدارة ليست جهة مستقلة من حيث المبدأ على الأقل، بل تابعة للحكومة، ومن ثمة فالاستقلالية مسألة تخص دستوريًا السلطة القضائية والتي هي بدورها استقلالية نسبية . فالسلطات الإدارية المستقلة تجمع الاختصاصين معا تنظيمي وعقابي. Abstract : The emergence of independent administrative authorities is linked to the requirements of good governance, by establishing and recognizing them reflects the growth of democracy in society because it is mainly based on the existence of bodies operating outside government control, enjoying guarantees that give them their articles of association and powers that allow them to perform their tasks, while getting rid of the control of the progressive executive authority The will. However, it is not always easy to adapt the legal position and nature of these bodies, which exercise administrative authority in particular sectors of activity, which led some commentators to say that they themselves constitute a contradiction within political traditions, in that the administration is not an independent body in principle at least, but rather Independence of the government, and from there independence is a matter of constitutional jurisdiction of the judiciary, which in turn is relative independence.
