جرائم الانحراف الجنسي في مجتمع المغرب الإسلامي من خلال وصف إفريقيا للوزان (10ه/ 16م) " قراءة في البواعث والإجراءات "

الملخص
يروم هذا البحث، تسليط الضوء على أحد المواضيع التي تندرج ضمن حقل الطابوهات والمحظورات التي لطالما سكت عنها وصدت عنها الأقلام، لذلك لا يزال تناولها من المنظور التاريخي يشق طريقه بخطى متثاقلة، وارتأيت أن تكون مساهمتي على أكثر الجرائم فتكا بالنوع البشري، في تاريخ المغرب الإسلامي في نهاية عصره الوسيط، والمتمثلة في جرائم الانحراف الجنسي، من خلال قراءة في كتاب وصف إفريقيا للحسن الوزان، مركزين بالأساس على الأسباب المادية والدوافع النفسية، التي أدت بالمجتمع المغربي بالتردي في حمئة هذه الجرائم، ثم الوقوف على أهم العقوبات التي سنها العقل التأديبي، كما تهدف هذه الورقة البحثية الى تقريب صورة أكثر واقعية عن طبيعة المجتمع المغربي بعيدا عن النظرة التمجيدية، وفي الوقت نفسه نسعى من خلال الموضوع التأكيد على نجاعة توظيف نص الرحلة في البحوث الانسانية عموما، واختراق مجال المحظور بالخصوص. وقد خلصنا من خلال دراستنا إلى مجموعة من الاستنتاجات ذات بعدين منهجي ومعرفي نوجزها في النقاط التالية: - وصف إفريقيا من المصادر الهامة في التاريخ الاجتماعي لبلاد المغرب بما في ذلك تاريخ المحضورات والطابوهات والجريمة. - وقوع فئات مختلفة من المجتمع في العديد من جرائم الجنس المنحرفة كالزنا واللواط والسحاق، وقد تعددت الأسباب منها ما هو مادي ونفسي، كما أكد الوزان على ضعف الوازع الديني كونه السبب الرئيسي. - تبقى هذه الجرائم أمرا شاذا عن مجتمع المغرب الإسلامي لم تصل لحد الظاهرة الاجتماعية بل تعرض مرتكب هذه الجرائم إلى عقوبات شرعية وعرفية إضافة إلى مقاطعة اجتماعية. Abstract: This research highlights one of the topics that fall within the taboos and taboos that have long been silent and repelled by pens. Therefore, I still take it from a historical perspective in a funny way, and I thought that my contribution to the most deadly crimes of human kind, in the history of the Islamic Maghreb at the end of its medieval age, represented in crimes of sexual deviations, through reading in the book "Description of Africa "For Hassan Al Wazzan, focus on The material causes and psychological motivations, which led the Moroccan society to deteriorate in the heat of these crimes, and then to identify the most important penalties enacted by the disciplinary mind. Emphasis on the effectiveness of the use of the text of the trip in humanitarian research in general, and penetrate the field of prohibited in particular. After conducting our study, we come out with a double set of findings; the systematic and the cognitive dimensions. They are summarized as follows: - Counting Africa as an important source in the social history of Maghreb including history of bans, taboo and crimes. - The fall of certain parts of the society in many deviant sexual crimes such as adultery, sodomy and lesbianism. Though the motives behind the issue were physical and psychological, it is stressed out that the core reason is the weakness of religious consciousness. These crimes remain uncommon for the Islamic Maghreb society; they did not spread to the social phenomenon likewise. Instead, the perpetrators of these crimes were subjected to legal and customary penalties along with social boycott
