آلية الدفع بعدم دستورية مضمونة لحماية الحقوق والحريات في النظامين الجزايري والفرنسي

الملخص
رفع الدعوى الدستورية بطريق الدفع الفرعي هي أكثر الأساليب شيوعا لتحريك الدعوى الدستورية ونكون بأن يدفع أمام قاضي الموضوع بعدم دستورية قانون معين يمس حق من الحقوق أو بحرية من الحريات التي يضمنها الدستور وهنا لا يجاب على مبدأ الدفع إلى دفعه تلقائيا بل لابد أن يتأكد القاضي أولا من توفر شروط وذلك تطبيقا لأحكام المادة 188 من التعديل الدستوري التي تحدد شروط تطبيق هذه المادة ، وان يكون الدفع من أحد الأطراف وهنا يثور التساؤل هل يجوز للنيابة العامة التدخل وللجمعيات أن يمارسوا الدفع بعدم الدستورية وللمتدخل التبعي .وان يكون الدفع يستند إلى حق أو حرية مضمونة دستوريا : والغرض من الإقامة الدفع حماية الحق أو الحرية بتقريرها إذا ما توزع فيها ، فالحق والحرية وجهان لعملة واحدة و الطابع الجديد للدفع بعدم الدستورية ان لا يكون قد صدر قرار في ذلك وأن يكون الدفع جدي وأن تكون متعلقة بالنص القانوني محل النزاع ويستبعد من هذا التطبيق النص الخارج كمن النزاع وإضافة إلى المادة 188 من الدستور . الكلمات المفتاحية الدعوى الدستورية –بطريق الدفع الفرعي –الحقوق – الحرية –الدستور Resume filling a constitutional lawasuit by subpayment is the most common way to move a lawsuit and it is to pay a constitutionnal judge before the unconstitutionality of a specific law that violates a rights or freedoms contained in a constitution and congratulates it does not bring on the principle of payment to pay it automatically but rather the judge must make sure of the availability of conditions for that in application and that te payment be from one of the parties and here the question arises whether the question arises whether the question arises the public prosescuttion for intervention and associations may practice the payment of unconstitutionality and the highest intervention and that the payment to that effect be to the right or freedom of two sides of the same currency and the new stampsfor the payment of unconstitutionality that no decision has been issued in thethat and that the payment was marginal and that it is the payment was marginal and that it isrelated to the legal text in dispute to the legal text in dispute and is recovered from here apply text outside of you and disputearticle 188 to spyware. key words constitutional –lawsuitby way of subsidiary payment -rights freedom- constitution
