الملخص
تعتبر المحكمة العليا أهم جهاز قضائي في الولايات المتحدة الأمريكية، حيث تأتي في قمة الهرم القضائي الفيدرالي، وذلك راجع لمركزها الدستوري والقانوني، إذ تعد المحكمة الوحيدة المكرسة دستوريا بخلاف بقية الجهات القضائية الأخرى التي عهد للكونغرس مهمة إنشائها حسب الظروف وكلما دعت الحاجة إلى ذلك، كما أن إجراءات تعيين قضاتها والجهة المختصة بذلك زاد من قيمة هذه المحكمة وعلو شأنها. وقد أنيطت بالمحكمة العليا عدة صلاحيات سواء فيما يخص الرقابة الدستورية، أو فيما يتعلق بالرقابة القضائية على أعمال الهيئات القضائية الأدنى منها، مما جعل طبيعة عملها يتمحور حول حماية مبدأ سمو الدستور وصون الحقوق والحريات من جهة، والفصل في قضايا معينة بصفة ابتدائية ونهائية، بالإضافة إلى تقويم أعمال بقية المحاكم الأمريكية من جهة أخرى، كما أن أحكامها لها دور حازم وحاسم في العديد من القضايا الشائكة، مما جعلها تحتل مكانة مرموقة وسط الشعب الأمريكي والعالم بأسره. the Federal Supreme Court is considered to be the most important judicial system in the United States of America, since it is at the top of the federal judicial pyramid, because of its constitutional and legal position; it is the only Tribunal dedicated to the constitution, unlike the other judicial institutions that the Congress has customarily established and instituted according to the circumstances and as much as necessary, as well as its procedures to designate its magistrates and the competent authority responsible for this, which has given it greater value and raised it to a higher rank. Several prerogatives have been assigned to the Supreme Court concerning either constitutional control or judicial control over the work of judicial institutions of a lower degree, so that Nature’s work is centred around the protection of the principle of the primacy of the constitution and the protection of rights and freedoms on the one hand, and to rule on specific cases first and last, in addition to the evaluation of the work of other American courts on the other hand, its judgments have a vital and crucial role in a number of difficult cases, occupying it an important place in the American people as well as in the eyes of the world.
