الملخص
ملخص: تعتبر السلطات الإدارية المستقلة أو ما يعرف بهيئات الضبط المستقلة الوجه الجديد لتدخل الدولة في ضبط الأنشطة التي تشرف عليها لاسيما الاقتصادية منها. و تتعدد المراكز القانونية لسلطات الضبط، فبعضها يتمتع بالشخصية المعنوية، بينما تنتفي هذه الصفة عن البعض الآخر. و يتمتع بعضها بالاستقلالية عن السلطة التنفيذية بينما يبقى البعض الاخر في وضعية تبعية. كما أنّ طبيعة علاقاتها مع الدولة تختلف باختلاف أنشطتها و أهميتها ضمن السياسة الوطنية للدولة. و حتى تؤدي مهامها، كرس المشرع نظام تعاون و اتصال بين هيئات الضبط المستقلة و السلطات العمومية يتبلور من خلال قنوات إتصال بينها و بين السلطات العمومية، جاءت في صور مختلفة، وضعت لاستكمال الفسيفساء الإدارية الجديدة للدولة، لكن ألا يمكن أن ينتج عن هذا التعدد في المراكز القانونية و عن نظام الاتصال القائم بين سلطات الضبط المستقلة و السلطات العمومية تعزيز لتدخل السلطة التنفيذية في نشاط هذه السلطات؟ Abstract : Independent regulatory authorities are seen as the new aspect of the state intervention in regulating the activities it supervises, particularly in the economic field. Independent regulatory authorities have different legal status; some have legal personality and others do not. Some of them are independent of the executive branch while others remain subordinate. The nature of their relations with the state varies according to their activities and their importance in the national policy of the state. In order to fulfill their functions, the legislator has set up a system of cooperation and communication between the independent regulatory authorities and the public authorities, which is constituted under communication channels. However, the analysis of the communication system between the public authorities and the independent regulatory authorities leads us to challenge their independence from the executive branch.
