الملخص

الملخص التمثيل بالقتلى في الفقه الإسلامي بين تأويلات التكفيرين ونصوص الشرع الحنيف تهدف هذه الدراسة إلى تسليط الضوء على واحدة من الشبه التي ينطلق من خلالها أصحاب الفكر التكفيري في تمثيلهم بالأحياء أو بالأموات من المسلمين أو غيرهم. وتكمن مشكلة الدراسة وجود من يحاول اتهام الشريعة الإسلامية بإباحة التمثيل بالقتلى، بإيراد جملة من النصوص الشرعية والروايات وأقوال العلماء التي تؤيد زعمهم، فجاءت هذه الدراسة لدحض هذه الشبه. وتتمثل أهمية الدراسة في عدم وجود دراسة مستقلة تجيب على الشبه التي تنطلق منها الجماعات التكفيرية في التمثيل بالقتلى. وقد اعتمد الباحثان في هذه الدراسة على المنهج الاستقرائي والمنهج التحليلي: وذلك بتتبع الأحكام المتعلقة بموضوع الدراسة من مظانها من القرآن الكريم، السنة المطهرة، والكتب الفقهية وكتب السيرة، ومحاولة فهم النصوص، ودراستها بشكل علمي، وبيان وجه الدليل فيها. وقد توصل الباحثان إلى جملة من النتائج كان من أبرزها براءة الشريعة الإسلامية من كل تلك التصرفات والأفعال التي يقوم بها أولئك الشرذمة، وأن ما يستندون إليه إنما هو من قبيل الأوهام، القائمة على للي أعناق النصوص واجتزائها بما يتوأم مع فكرهم الإجرامي المنحرف. الكلمات المفتاحية: التمثيل - القتلى – الفقه – التكفيريين. Abstract Mutilation of Corpses in Islamic Jurisprudence between the Interpretations of Takfirists and the Provisions of the Islamic ShariahPrepared by: Dr. Mohammed Ahmed AL – Ghoul Dr. Alaa Ahmed QudahThis study aims at shedding light on one of the suspicions، which is relied on by the takfirist terrorists to mutilate the living or the corpses of Muslims or others. The problem of the study is those who try to accuse the Islamic Shariah of permitting the mutilation of corpses، by citing a number of the Islamic Shariah provisions، the narratives and the statements of the scholars who support their claim. This study came to refute this suspicion. The importance of the study is derived from the absence of an independent study answering the suspicions on which rely the Takfirist groups in their mutilation of corpses. In this study، the researchers relied on the inductive method and analytical method: by tracing the provisions related to the subject of the study from its sources، namely the Quran، the Sunna of the Prophet، the books of Islamic law، the relevant books about the life and traditions of the Prophet and history books. Then، the researcher sought to understand the texts and study them scientifically، in an attempt to indicate the evidence in it. The researchers found a number of results; most notably the Islamic Shariah is innocent of all these acts and actions carried out by this band، and that their basis is a delusion built on the selective use and distortion of the provisions of the Islamic Shariah in compliance with their delinquent criminal thought.
