تنظيم الحرية الدينية في القانون الدولي

الملخص
الحرية الدينية هي واحدة من أقدم الحريات و أكثرها مثارةً للجدل ضِمن دائرة حقوق الإنسان. ولقد أضحت موضوع انشغال دولي منذ بدايات نظام المجتمع الدولي المعاصر. فالإعلان العالمي لحقوق الإنسان اعترف بالحرية الدينية كحق عالمي، وهي تنطوي على حق أساسي لكلّ إنسان يكون له حرية اختيار اعتناق دين أو معتقد ما أو عدم الاعتناق وكذا حرية ممارسة هذا الاختيارفي العلن من دون الخضوع للإكراه أو التمييز. فحرية الفكر، الوجدان والدين هي حرية بارزة ضمن مجال حقوق الإنسان وتجد أساسها في الآليات الدولية الرئيسية لحماية حقوق الإنسان، وهي إلى حدّ بعيد تُعتبر بمثابة مفتاح جوهري في نظام هذه الحماية. كما أنّ لها علاقات مضطربة مع حريات أخرى مثل حرية التعبير، ويُلاحظ ذلك عندما يحصل التقاطع بين المجال الذي تتطلبه الصفة الجماعية للحرية الدينية وبين الطابع الفرداني لحقوق الإنسان، وهو ما يُشكِّل مصدرًا للخلاف. هناك أيضًا صُعوبات أخرى تعترِض الحرية الدينية، لاسِيّما عندما تكون مُتصِّلة بحُرية مُتلازِمة معها، وعندما تكون خاضِعة لنِظام من القيود المشروعة. Freedom of religion is one of the oldest and most controversial of all human rights and has been the object of international concern from the very beginnings of the modern international state system .The universal declaration of human rights recognizes religious freedom as universal right. Religious freedom is the fundamental of every human being to freely choose a religion, or to have no religion, and to pursue that belief publicly, without being a victim of oppression or discrimination. The freedom of thought, conscience and religion is a well attested component of the human rights canon. It is found in the principal international human rights instruments and is widely regarded as a key elements of the protective framework. Yet it has an uneasy relationship with other elements of human rights, such as the freedom of expression, and the degree to which the realization of the freedom of religion necessitates a collective as opposed to an individualist paradigm can be a source of further friction. There are also difficulties in locating where the freedom of religion lies in relation to the freedom of association as well, as the problems of determining when the freedom of religion can be subject to legitimate restriction within a human rights framework.
