التوقيع الإلكتروني وسيلة حديثة للإثبات - دراسة مقارنة-

الملخص
غيّر ظهور الشبكة الإلكترونية العالمية (الانترنت) الموازين والقواعد التقليدية المتعارف عليها، بعد أن أصبحت هذه الشبكة صلة الوصل الأساسية في تبادل المعلومات، الخدمات والصفقات، سواء أكانت تجارية أو غير تجارية فظهرت السندات أو المحررات الإلكترونية التي لا ترتكز على دعامة ورقية مما أدى إلى تطور التوقيع الذي أخذ شكلا عدديا أو رقميا جديدا يعرف بالتوقيع الإلكتروني، هذا الأخير الذي أصبح من أهم آليات الإثبات في المعاملات الإلكترونية التي تتم عبر وسائل الاتصال الحديثة بمختلف أنواعها وأشكالها. Le réseau électronique mondial (Internet) a changé les rapports et les règles traditionnelles connues jusque-là, devenant le trait d’union principal dans l’échange d’informations, des services et des marchés commerciaux ou autres, d’où l’apparition des titres et des écritures électroniques qui se passent du papier, ce qui engendré le développement de la signature qui a pris une nouvelle forme numéraire ou numérique connu sous le nom Signature électronique devenue l’un des mécanismes de justification dans les opérations électroniques par voie des nouvelles différentes télécommunications. Summary The global electronic network (Internet) changed reports and traditional rules known so far, becoming the hyphen in the exchange of information, services and commercial or other markets with the appearance of titles and electronic documents without need of paper. This led to the development of the signing in its numeral and numeric forms known as electronic signature, becoming the most important mechanism for proof in the electronic transactions by way of different new telecommunications.
