منازعات علاقة العمل في المجال الرياضي.

الملخص
الملخص: إن الأصل بالنسبة للرياضي باعتباره عامل لدى النادي الذي يعتبر مستخدم أو صاحب عمل، أنه يخضع لذات الالتزامات التي يخضع لها باقي العمال، بالإضافة إلى التزامات أخرى تفرضها الصبغة الرياضية على العمل، حيث أنه فضلا عن التزامه بأداء العمل الرياضي وبذل العناية اللازمة في ذلك وكل ما يتطلبه العمل فإنه يلتزم أيضا بالتزامات أخرى تتعلق أساسا بنشاطه الرياضي، كالمحافظة على صحته ولياقته البدنية وعدم تعريضها للخطر وذلك بإتباع نمط حياة صحي، بالإضافة إلى احترام علاقات النادي برعاياه. وإذا أخل الرياضي بالتزاماته حق للنادي أن يوقع عليه جزاءات تأديبية معينة، وذلك بموجب ماله من سلطة تأديبية عليه، كما أن للاتحاد المسؤول عن النشاط الرياضي سلطة تأديبية على الرياضي وذلك في حدود السياسة التي يرسمها هذا الأخير من أجل ترقية النشاط الرياضي ومن جانبه يلتزم النادي بصفته صاحب العمل بالالتزامات التي تقع على عاتق أصحاب العمل وذلك في إطار عقد العمل بالإضافة إلى التزامات ثانوية أخرى. وفي حالة نشوب صراع بين أطراف هذه العلاقة بمناسبة تنفيذها أو أثناءها، فيجب عليهما في البداية عرض النزاع على الجهات المختصة على مستو الهيئات المعنية كالاتحاد والرابطة سواء كان النزاع على مستوى دولي أو وطني، فإذا كان وطنيا يتم اللجوء إلى هذه الهيئات على المستوى الوطني، بما فيهم محكمة التحكيم الرياضية على المستوى الوطني، أمام إذا كان دوليا فيتم اللجوء إلى الهيئات الدولية كالاتحاد الدولي المعني و محكمة التحكيم الرياضية الدولية، فإذا لم يفلح ذلك، فيبقى للأطراف اللجوء إلى القضاء العام أي التابع للدولة. :Resume The origin of the athlete as a worker of the club which is a user or employer is that he is subject to the same obligations as the rest of the workers, in addition to other obligations imposed by the sporting character on the work, as well as his commitment to perform sports work and to take care of it and everything Requires work, it also complies with other obligations related mainly to his sports activities, such as maintaining his health and fitness and not endanger them, following a healthy lifestyle, in addition to respect for the club's relations with his . subjects If the athlete disobeys his obligations, the club has the right to impose disciplinary sanctions on him, in accordance with his own authority, and the union responsible for sports activity shall have disciplinary authority over the athlete within the limits of the policy set by the latter in order to promote sports activity.
