أثر وسائل الاتصال الحديثة على إبرام عقد الزواج وإنهائه

الملخص
ملخص: قد مست التكنولوجيا مجال الأحوال الشخصية حينما بات إبرام عقد الزواج الذي يعتبر أهم تصرف يبرمه المرء في حياته ممكنا بوسائل الاتصال الحديثة وما يستتبع ذلك من آثار هامة على مكونات الأسرة وما يثمره من حقوق للزوجين ونسلهما. وبالمثل بات ممكنا الاعتماد على وسائل الاتصال الحديثة في إنهاء الرابطة الزوجية؛ فوسائل الطلاق المستحدثة باتت تتيح سهولة في هدم أخطر عقد يبرمه الشخص في حياته . فمسألة الزواج بالوسائل الحديثة يقتضي التمحيص وتتبع تأصيل مع وضع ضوابط له. أما الطلاق بالطرق الالكترونية فندعو المشرع إلى منع العمل به وعدم الاعتراف بآثاره. Abstract: Today Technology is about personal status, especially the conclusion of a contract that is the most important conduct of one's life, namely the marriage contract, which has important effects for the couple and their offspring. In the same way, it is possible to use modern means of communication to put an end to the conjugal bond, which is more important than to construct it by the same means in terms of the negative effects of facilitating divorce. However, from the point of view of family law derived from Islamic law as an objective source of its provisions, it is necessary to scrutinize and follow with Constraint. The legislator is invited not to recognize the effects of divorce by electronic means
