الملخص
ملخص: ألقى التطور التقني والتكنولوجي بظلاله على الأسرة، وأثَّر على تنشئة أفرادها، وعلاقاتهم الاجتماعية، وامتد إلى إبرام عقد الزواج الكترونيا. لذلك خصصنا هذه الدراسة لظاهرة إبرام عقد الزواج عبر وسائل الاتصال السمعية المرئية، محاولين وضع تكييف لمجلس عقده، وصحته شرعا وقانونا، لنخلص إلى ضرورة استحداث نصوص تكفل حجيته، وتوفر حماية لأطرافه. Résumé : L’évolution technique et technologique a jeté son ombre sur la famille, car non seulement elle a al-téré l’éducation de ses membres mais également leurs relations. Cette mutation relationnelle s’est propagée jusqu’à la conclusion de l’acte de ma-riage par voie électronique. D’où, cette étude porte sur ce nouvel mode de passation du lien ma-trimonial, par le biais des différents moyens de té-lécommunication audiovisuels. Cette nouvelle vi-sion nécessite le fait de savoir si elle est en par-faite concordance avec les textes en vigueur ? Qu’en est-il de la validité du mariage ainsi conclu? Abstract: Technological and technical developments have cast a shadow over the family, because not only has it altered the education of its members, but also their relationships. This relational mutation spread to the conclusion of the marriage certificate electronically. Hence, this study focuses on this new method of transferring the matrimonial bond through the various means of audiovisual tele-communication. Does this new vision require kno-wing if it is in perfect agreement with the current texts? What about the validity of the marriage?
