التحكيم في عقود النفط دراسة مقارنة بين قواني الجزائر والكويت

الملخص
يعتبر التحكيم الوسيلة الإجرائية الأولى الأكثر قبولا وبعثا للطمأنينة لدى المستثمر النفطي الأجنبي، لذلك لا يخلو عقد من العقود النفطية بين أطرافه، دون أن يتم التأكد على اللجوء لهذه الوسيلة كأداة حماية إجرائية خاصة بالنسبة للمتعاقد الخاص الأجنبي، فاللجوء إلى التحكيم في بداية الأمر ناتج من تخوف أحد الطرفين من قاضي الطرف الآخر لحل الخصومة، فقد كان التحكيم مجرد بديل عن القضاء الوطني، لكن فيما بعد أصبح هذا الأخير أساس حل هذه الخصومات وسبيلا مقبولا في حال فشل المفاوضات بين الطرفين. وانطلاقا من ذلك نصت بعض التشريعات الوطنية ومنها الجزائر والكويت على امكانية اللجوء إلى التحكيم بشأن تسوية منازعات عقود التنمية الدولية والتي منها بطبيعة الحال عقود النفط، لذلك يعتبر التحكيم الوسيلة الأولى لضمان الحماية الإجرائية للمتعاقد الخاص الأجنبي في مجال العقود النفطية على وجه الخصوص، فماهي أهم الأسباب والدوافع التي أدت إلى اللجوء للتحكيم؟ The arbitration procedural means first the most accptable to the investor oil foreign, so it is not without a contract between the parties, without being sure to resort to this method as a tool procedural protection especially for contracting foreign private, recourse to arbitration at the beginning of it the result of fear of judge sides of the other party to resolve the litigation, arbitration was just a substitude of national courts , but later become the basis of the latter resolve these discounts and acceptable way in the event of failure of the negotiations between the two parties. Based on this, provided some national legislation, including Algeria,Kuwait and the United Arab Emirates ,on the possibility of recourse to arbitration for settlement of disputes,contracts for international development and from which of course the oil contracts, so it is considered arbitration primary means to enssure procedural protections contracts , in particular, which version the most important reasons and motves that led to resort to arbitration ?
