علاقة علم مقاصد الشريعة الإسلامية بعلوم الحديث The Relationship Of The Science Of The Makassed Of Sharia To Hadeeth Science

الملخص
كثر الاهتمام في الآونة الأخيرة بعلم المقاصد، تأسيسا على التجديد الذي قام به الطاهر بن عاشور في تونس، وما تلاه من جهود للعلماء فيه، لكن بالرغم من كل الجهود إلا أن الحاجة متزايدة إلى إنضاج هذا العلم تقعيدا وتفريعا؛ ولاسيما بعد تزايد الهجمة على السنة النبوية، وكان من أساليب تلك الهجمات اعتمادهم لأسلوب ظاهره (النقد العلمي) ولكن حقيقة أكثره الطعن والتشكيك، حيث كان مُؤدّى تلك الدراسات -التي تتظاهر بالنقد الحديثي- ردّ الأحاديث الصحيحة، وتغيير معاني أخرى، أو إبطال أحكامها، وكانت حجة نقدهم ذاك: أنها تتعارض مع (العمل بالمقاصد)، ومن تأمل حقيقة عملهم يجدهم قد اتخذوا المقاصد ستارا لتحريف مناقض للمقاصد الواردة في الشريعة والتي ذكرها العلماء قديما أو حديثا. فحاولنا في هذا البحث معالجة أهم الإشكالات الناتجة عن عمل بعض العلماء في المقاصد؛ ولاسيما ما يتعلق بالسنة النبوية، وقصدنا فيه أن نُزيل بعض الإشكاليات المتولدة في أذهان بعض الباحثين والدارسين، سواء في علم المقاصد أو في الحديث الشريف وعلومه، وكذلك بيان مواطن العلاقة بينهما، كمحاولة لتأسيس نقطة انطلاق نحو بناء قواعد وضوابط للعمل المقاصدي المستنبط من السنة النبوية المشرفة. وقد حاولنا إيضاح العلاقة بين (علوم الحديث) وبين (علم المقاصد)، وبيان الحدود التي يجب مراعاتها عند الولوج في (مقاصد السنة النبوية)، والقواعد التي يجب الالتزام بها، ليكون العمل المقاصدي في دراسة السنة النبوية منضبطا بالضوابط العلمية، ومتوازنا بين الإفراط والتفريط، كمحاولة لجعل هذا البحث يجيب على إشكالات علمية منها: • هل الفهم المقاصدي لما ورد في السنة النبوية جديد، أم قديم؟ • هل استخدم علماء الحديث (المقاصد) في علومهم (علوم الحديث)؟ وأين نجد ذلك؟ • ما هي حدود العلاقة بين علوم الحديث وعلم المقاصد؟ • وهل يمكن جعل الفهم المقاصدي المستنبط ضابطا للحكم على ثبوت الحديث، أو قبوله وردّه؟ • وكيف نستطيع توظيف علم المقاصد في بيان الإشكاليات المثارة حول السنة؟ Abstract Recently there has been growing interest in the science of Makassed (purposes), based on the renewal undertaken by Tahir Ben Ashur in Tunisia, and the subsequent efforts of the scholars in it. However, despite of all these efforts, the need for this science is gradually increasing especially after the attacks on the Sunnah of the prophet Mohammed (PUH) , and one of the methods of these attacks is based on the (scientific criticism), but in fact most of those ways focus on the questioning, where the result of the studies - which pretend to be modern criticism - is to suspect in the Hadeeths which are Saheeh (confirmed), and change other meanings, or invalidate the provisions, and the argument of criticism that: they conflict with (Working with Makassed). When one focuses and analyzes their work, he finds that they have taken (Makassed) as a cover to distort the meaning of Makassed contrary to the real meaning which has been mentioned in Sharia and by scholars since the past till nowadays. In this research, we tried to address the most important problems resulting from the work of some scholars in Makassed, especially with regard to the Prophetic Sunnah. We intended to remove some of the problems that arise in the minds of some scholars and researchers, both in the Science of Makassed and Prophetic Hadith and the relationship between them. In an attempt to establish a starting point towards the construction of rules and disciplines for the work of the Makassed derived from the honorable Prophetic Sunnah. We have tried to clarify the relationship between the science of Hadith and the science of Makassed, and define of the limits that must be observed in the (Makassed of the prophetic Sunnah) and the rules which must be adhered to, so that the study of the Sunnah is governed by scientific disciplines and balanced between exaggeration and ignoring, As an attempt to make this research answer the scientific problems, including: • Is the Makassed understanding of what is mentioned in the Sunnah new or old? • have the scholars of Hadith (Makassed) used their sciences (Hadith)? Where do we find that? • What are the relationship between Hadith science and the science of Makassed? • Is it possible to make the Makassed understanding as a regulation to rule on the authenticity of the hadith, its acceptance or rejecting it? • How can we employ the Makassed science to explain problems raised around the Sunnah?
