الملخص

الملخص: تتناول هذه الدراسة أثر انهيار العملة الوطنية إلى أدنى مستوياتها حاليا، مقارنة مع العملة الأجنبية التي سيكون لها أثر كبير على الآثار المالية لفك الرابطة الزوجية، خاصة على المتعة والمتاع لمالها من أهمية بالغة في تقدير التعويض الذي سيحكم به قاضي شؤون الأسرة. ذلك أن هذا الانهيار سيؤدي إلى ضعف القدرة الشرائية للمواطن مما ينعكس بالسلب مباشرة على القيمة الحقيقية لمبلغ المتعة وقيمة متاع البيت، لذلك يتعين على قاضي شؤون الأسرة عند حكمه بالمتعة وتقديره لمتاع البيت خاصة الذي يكون قد هلك او أتلف أن يراعي القيمة الحقيقية للدينار، وأن يحكم بقيمة تعويض تتماشى مع سقوط العملة من ناحية، وتلبي حاجيات المطلقة من ناحية أخرى. Abstract: This paper tackles the impact of the deprecation of the national money to the lowest level. In camparison with the foreign money which will have a great impact on the material effects to the dessolution of the conjugal relationship; especially for the right of cohabitation and the material because of its importance in the evaluation of the compensation deemed by the judge of the family. That why this depreciation will lead surelly to the weakness of the baying hability of the citizen which effect passivelly to the real value of the cohabitation and the materials. That why the family judge has to take into consideration the real value of the money ; natably in the case of destruction or missing. Furthermore, he has to decide a compensation which is fit with the real value of the money on one hand, and which responds to the needs of the devorced woman on the the other hand.
