أثر النّظر المقاصدي في بناء الكلّيات الأصولية: ما ورد في مختصر الرّوضة للطوفي نموذجا

الملخص
ملخص: عالجت المقالة طرفا من تأثير الخلفية المقاصدية والفقه المصلحي عند النّاظر على نتاجه الأصولي سواء صحّت هذه الرابطة أم أخطأت الهدف، وقد جُلّيت هذه العلاقة بعد تأصيلها وبيان أهميتها من خلال بعض النماذج التي وردت في مختصر الطوفي على روضة الناظر. وقد خلصت في خاتمة كلّ نموذج إلى إثبات ما ينبني عليه من إشارة مقاصدية كلّية، وهذا وجه آخر للبناء المقاصدي الكلّي الذي هدفت الدراسة إلى إبرازه. وانتهت الدراسة بالتوصية ببحث استقرائي موسّع يتناول جوانب هذه العلاقة. Abstract: The article dealt with a part of the influence of the macadamic background and the jurisprudential philosophy of the beholder on its fundamentalist product, whether this association was true or wrong. The relationship was forged after its rooting and its importance was expressed through some of the models that appeared in Al-Tofi. At the end of each model, I found the evidence of a total macroscopic reference, and this is another aspect of the total conceptual construction that the study aimed at highlighting. The study concluded by recommending an extensive inductive study dealing with aspects of this relationship
