الملخص
تطرقت الدراسة لدور إعلان هلسنكي في تأسيس التجارب الطبية واحترامه لحقوق الإنسان، وذلك من خلال بيان المبادئ العامة التي يرتكز عليها إعلان هلسنكي التي تم تقسيمها إلى مبادئ متعلقة بالفئة المعنية بمجال البحث الطبي ومبادئ متعلقة بالبحث الطبي ومبادئ متعلقة بالحالة البشرية موضوع البحث الطبي، ثم من خلال الأحكام الأخرى التي أقرها إعلان هلسنكي، سواء ما تعلق منها بالأفراد والجماعات المشاركة في البحث الطبي سيما الموافقة المسبقة المستنيرة، وكذا الأحكام المتعلقة بالأفراد والجماعات الضعيفة المشاركة في البحث الطبي، وأحكام أخرى متعلقة بالبحث الطبي ومن ذلك ما تعلق بالمخاطر والأعباء والفوائد المرتبطة بالبحث الطبي، والمتطلبات العلمية وبروتوكولات البحوث، ولجان أخلاقيات البحوث، والتدخلات غير المثبتة في الممارسة السريرية واستخدام الدواء الوهمي، ثم احترام خصوصية وسرية الدراسة البحثية وضرورة تسجيلها، ثم تطرقت الدراسة لبيان مدى فاعلية إعلان هلسنكي في تأسيس التجارب الطبية واحترام حقوق الإنسان من خلال تحديد الأثر القانوني لإعلان هلسنكي، ومدى احترامه لحقوق الإنسان، ثم ربط نصوص إعلان هلسنكي بالواقع الطبي، وخلصت الدراسة في الأخير بمجموعة من التوصيات والمقترحات. Abstract: The study sheds light on the role of the Helsinki Declaration in the establishment of medical experiments and respect for human rights by declaring the general principles underlying the Helsinki Declaration, which were divided into principles related to the medical research category, medical research principles and principles related to the human condition of medical research, The other provisions adopted by the Helsinki Declaration, relating both to individuals and groups involved in medical research, in particular prior informed consent, as well as provisions concerning individuals and vulnerable groups involved in medical research, And other provisions related to medical research, related to the risks , burdens and benefits associated with medical research, scientific requirements, research protocols, and research ethics committees, and Unproven Interventions in clinical practice and the use of placebo, then respect the privacy, confidentiality of research study and the need to register. The study demonstrates the effectiveness of Helsinki Declaration on the Establishment of Medical Experiences and Respect for Human Rights by determining its legal effect, its respect to human rights. Then linking the texts of the Helsinki Declaration to the medical reality. The study concluded with a set of recommendations and proposals.
