نحو تفعيل تدريس مقاصد الشريعة: خطبة حجة الوداع نموذجا

الملخص
ملخص تهدف هذه الدراسة إلى: تسليط الضوء على تفعيل تدريس مقاصد الشريعة، وعمل دراسة تحليلية، لخطبة حجة الوداع، وتنزيلها على الواقع المعاصر، كاستراتيجية شرعية، وكيف أن هذه الخطبة قد حققت مقاصد الشريعة، في حفظ الكليات الخمس: الدين، النفس، النسل أو العرض، العقل، والمال. وأبرزت الدراسة : أن خطبة حجة الوداع ، تعتبر أول إعلان لحقوق الإنسان، موجهًا من النبي محمد صلى الله عليه وسلم ليس إلى أمته فقط، وإنما إلى البشرية جمعاء، كما أظهرت الدراسة، من خلال القراءة التحليلية الهادفة لخطبة حجة الوداع، أن تلك الخطبة، خير وسيلة لتفعيل تدريس مقاصد الشريعة، ودليل من الأدلة، التي تنير درب الفقيه ،في استنباط الحكم الشرعي، ومنهج لوقاية المجتمع من الجريمة. Abstract This study aims to: highlight activation teaching purposes of Sharee'ah, and the work of an analytical study, the sermon Farewell, and download them to the contemporary reality, strategy legitimacy, and how this sermon has achieved the purposes of Shariah, in keeping the five colleges: religion, psychology, birth control or display mind and mony. The study highlighted: that sermon Farewell, is the first declaration of human rights, directed the Prophet Muhammad × not to his nation only, but to all of humanity, as the study showed, through analytical reading aimed at sermon Farewell, that that speech, the best way to activate teaching purposes of the law, and evidence from the evidence, that illuminates the path of al-Faqih, in devising legal judgment, and an approach to protecting society from crime.
