الملخص
للأضرار التي قد تترتب من خلال عمليات البناء و التشييد، فقد تدخل المشرع لتقرير المسؤولية العشرية للمتدخلين في عملية الترقية العقارية من مقاولين و مهندسين. و لكن بسبب التطورات المعاصرة التي مست حتى طريقة البناء و الوسائل المعتمدة فيه، فقد عمدت بعض التشريعات إلى التوسيع من المجال الشخصي للمسؤولية العشرية كالقانون الجزائري بموجب قانون11-04 وخاصة المادة 46 منه، لتشمل الصانع و حتى المقاول الفرعي الذي شارك في عملية البناء. Abstract : As a result of damage that may arise from the building or during construction operations, the legislator intervened to determine the decimal responsibility of the participants in the property development process contractors and engineers .But because of the contemporary developments that affected the way of building and the means adopted, some legislation aimed at extending the personal area of decimal responsibility, such as Algerian law under the law of 11-04, and in particular Section 46, which extended the scope of this responsibility to the manufacturer and even to the sub-contractor who was involved in the construction process
