التأمين عن المسؤولية العشرية في مجال البناء

الملخص
يعد التأمين عن المسؤولية العشرية من أهم أنواع التأمينات في وقتنا الحاضر،نظرا لما تحتله أعمال البناء والتشييد من مكانة هامة وما ينتج عنها من أضرار ناتجة عن عيوب في عملية التشييد. ولما كان التعويض عن هذه الأضرار يشكل عبئا ماليا يقع على عاتق المسؤول ،ويزداد الأمر أهمية نظرا لتواجد عدة متدخلين في عملية التشييد،بحيث يصعب معه تحديد من هو المسئول عن هذا الضرر،لهذا تدخل المشرع بموجب الأمر 95-07 المتعلق بالتأمينات وفرض التأمين عن هذه المسؤولية للمتدخلين في عملية البناء،والهدف منه –التأمين-تغطية الأضرار التي تصيب المسئول في ذمته المالية. Abstract: The insurance of the tenth liability is one of the most important types of insurance in the present time, because of the construction works and the construction of an important position and the resulting damage caused by defects in the construction process. Since the compensation for these damages is a financial burden on the official and is more important because of the intervention of several people in this process, it is difficult to determine who is responsible for this damage, so the legislator intervened under Ordinance 95-07 on insurance and the imposition of insurance for this responsibility to those involved in the process Construction, and the purpose of this insurance is to reparation and compensation before searching for any liability.
