لقيود المقررة لفرض العقوبات الاقتصادية الدولية الواردة ضمن الفصل السابع من ميثاق الأمم المتحدة

الملخص
تهدف هذه الدراسة إلى تبيان أهم القيود المقررة لفرض العقوبات الاقتصادية الدولية الواردة ضمن الفصل السابع من الميثاق . و هذا من خلال اعتبار أن العقوبات الدولية و خاصة العقوبات الاقتصادية الدولية التي جاءت لتلبية أهداف المجتمع الدولي، و ذلك من خلال تحقيق الأمن و السلم الدوليين. و باعتبار أن العقوبات الاقتصادية الدولية كانت نتيجة الماسي و الكوارث التي خلفتها الحرب العالمية الثانية ، إلا أن التعسف في استعمال هذه العقوبات و تجاوز آليات تحقيقها أصبح أمر يهدد حياة الآلاف المواطنين و المجتمع المدني الدولي بصفة عامة سواء في كيانه المادي أو المعنوي و كذا المقدسات و الآثار المحمية دوليا . ولكن و بالرغم الذي يلعبه مجلس الأمن من خلال صلاحياته الواسعة في تحقيق السلام العالمي و حماية حقوق و حريات الإنسان الأساسية ، إلا أن الواقع يعكس نظرة ذلك من خلال انتهاك حقوق الإنسان . لذا كان الهدف من الدراسة هو استظهار أهم القيود كاستثناء عن القاعدة العامة و هي فرض العقوبات الاقتصادية عن كل من أخل بالتزاماته الدولية . This study aims at showing the most important decided limitations for imposing the International Economic Penalties, which are mentioned within the 7th chapter of the Charter. Considering that the International Penalties in general and the Economic ones in particular has been set for the sake of realizing the international community’s objectives including achieving and maintaining the international peace and security. Taking into consederation also that the International Economic Penalties were resulted from the 2nd World War’s catastrophes and tragedies, but the arbitrariness in using these penalties and surpassing the means of achieving them has become a serious threat to thousands of citizens’ life and the international civil community in general either on its physical entity or moral one, in addition to the holy places and the internationally protected monuments. Despite of the UN Security Council’s role in achieving the international peace and the protection of the human principal rights and liberties through its broad powers, the reality reflects the total opposite through the violation of the human rights, hence this study’s aim is to demonstrate the most vital limitations as an exception to the general rule which is to impose economic pinalties on everyone breached his international commitments.
