رخصة الهدم في النظام القانوني الجزائري

الملخص
تعتبر رخصة الهدم من ميكانزمات الرقابة التي تمارسها الإدارة من أجل وقاية البيئة من الأخطار التي تنجم عن عملية هدم البنايات، فرغم أن الأصل هو حرية الأفراد في هدم بناياتهم دون حاجة إلى ترخيص إداري مسبق، إلا أن المشرع الجزائري قيّد هذه الحرية بضرورة الحصول على رخصة الهدم إذا تعلق الأمر بالبنايات المحمية بأحكام القانون رقم 98-04 المتعلق بحماية التراث الثقافي أو إذا إقتضت ذلك الشروط التقنية والأمنية . Abstract: The demolition permit is one of the control mechanisms used by the Department to protect the environment from the dangers resulting from the demolition of the buildings, Although the original is the freedom of individuals to demolish buildings without prior permission, However, the Algerian legislature restricts this freedom to obtain a demolition permit when it comes to buildings protected by the provisions of Law No. 98-04, Or if such technical and security requirements are required.
