أسس فكرة الأمن القانوني وعناصرها

الملخص
يعد مبدأ الأمن القانوني أحد أهم الأسس التي يقوم عليها بناء الدولة القانونية ذلك أن فكرة الأمن القانوني تعنى بضرورة التزام السلطات العامة في الدولة بتحقيق قدر من الثبات النسبي للعلاقات القانونية وحد أدنى من الاستقرار للمراكز القانونية المختلفة بهدف إشاعة الأمن والطمأنينة بين أطراف العلاقات القانونية، بحيث يتمكن الأشخاص من التصرف باطمئنان على هدي من القواعد والأنظمة القانونية القائمة وقت قيامها بإعمالها وترتيب أوضاعها على ضوء منها، دون التعرض لمفاجآت أو تصرفات مباغتة صادرة عن السلطات العامة يكون من شأنها زعزعة هذه الطمأنينة أو العصف بهذا الاستقرار.
