Résumé

شهد تسيير الموانئ في السنوات الأخيرة تطورات جد سريعة، إذ تحولت إستراتيجية الدول إلى تشجيع التمويل الخاص. من خلال عقد امتياز يُمنح للقطاع الخاص حتى يتسنى له المساهمة في التسيير والاستثمار وفقا لشروط عقد الامتياز. ويعد مبدأ الامتياز الأكثر فعالية بربطه القطاع الخاص بالقطاع العام من جهة، و تطويره لمفاهيم التسيير الحسن للموانئ، وفق القوانين والنظم الجديدة المعمول بها دوليا من جهة أخرى، وفي هدا الإطار استغلت الدولة الجزائرية هدا النوع من التسيير لادارة موانئها، خاصة موانئ كل من الجزائر العاصمة و بجاية و جيجل بداية من 2004، هذا ما استوجب علينا الاجابة على بعض التساؤلات حول الآثار التي نجمت عن اتباع هذا النمط الجديد في التسيير و على وجه الخصوص عقد الامتياز. Résumé : La gestion portuaire a connu des développements très rapides ces dernières années, car les Etats ont modifié leur stratégie en encourageant le financement privé sous forme de concession, afin qu'il puisse contribuer à la gestion et à l'investissement conformément au contrat de concession. Le principe de la concession peut être le plus rentable et le plus efficace d’où il permettra de relier le secteur privé au secteur public d'une part et d’autre part de développer les concepts de la bonne gestion des ports , conformément aux nouvelles lois et Nouveaux systèmes utilisés à l'échelle internationale , dans ce cadre, l'Etat algérien a profité de ce type de gestion pour ses ports, particulièrement les ports d’Alger, de Bejaia et de Jijel depuis 2004, ce qui nous oblige à poser quelques questions sur les effets qui en résulte de ce nouveau mode de gestion, notamment le contrat de concession. Summary : Port management has undergone very rapid developments in recent years, as states have been able to modify their strategy by encouraging private financing in the form of a concession so that it can contribute to management and investment in accordance with the concession contract. the concession principle may be the most cost-effective and efficient way to link the private sector to the public sector on the one hand and to develop the concepts of good port management in accordance with the new laws and New systems used internationally, in this context, the Algerian State has adopted this type of management for its ports, particularly the ports of Algiers, Bejaia and Jijel since 2004, which requires us to ask some questions about the resulting effects of this new management mode, notably the concession contract
