خصوصية الجزاء الجنائي في مجال المنافسة

الملخص
ملخص: تعرف مسألة اختصاص القاضي الجزائي بقمع ومكافحة الممارسات المنافية للمنافسة تحولات وتقلبات تشريعية كثيرة، بدأت بالإقرار التام له بالتصدي وبصرامة لهذه لمخالفات وذلك بموجب قانون الأسعار رقم 89-12، ليأتي بعدها الأمر رقم 95-06 المتعلق بالمنافسة الذي أبقى على هذا النوع من التدخل للقضاء وذلك في حدود ضيقة، غير أنه سرعان ما صدر الأمر رقم 03-03 الذي أحدث قفزة نوعية بخصوص هذا الشأن، حيث ألغى تماما الأمر رقم95-06 السابق ولم يعد يعترف للقاضي الجزائي بأي تدخل في مجال المنافسة. وهو ما أبقاه في التعديلات اللاحقة بموجب قانوني 08-12 و 10-05، وبذلك يتأكد تكريس المشرع الجزائري لظاهرة إزالة التجريم في مجال المنافسة، مما أدى إلى استبدال الجزاء الجنائي بجزاءات مالية أكثر شدة وقسوة تتماشى مع طبيعة هذه المخالفات. كلمات مفتاحيه : مبدأ إزالة التجريم ، القاضي الجزائي ، مكافحة ، الجزائر. SUMMARY : The question of the competence of the criminal judge to suppress and combat anti-competitive practices is defined by many legislative transformations and changes, which started by its fully recognition by severely struggling these violations within Prices Law No. 89-12, followed by Order No. 95-06 on the competition settling the limited intervention of justice, and soon the Order 03-03 which made a quantum leap in this regard, abolishing completely the previous order 95-06 and no recognition of the interference of the criminal judge in the field of competition, what was retained in the subsequent amendments under Law 08-12 and 10-05, thereby ensuring that the legislator was consecrated to fight against the phenomenon of criminalization in the field of competition, which led to the replacement of the criminal penalty with more severe financial penalties consistent with the nature of these irregularities.
