الوظيفة التشريعية لمجلس الأمة الجزائري من خلال التعديلات الدستورية لسنة 2016

الملخص
ملخص: يعد مجلس الأمة الجزائري الذي تم استحداثه بموجب دستور 28 نوفمبر 1996 مؤسسة تشريعية تجسد نظام الغرفتين في البرلمان الجزائري، حيث من المفروض أن تتمتع هذه المؤسسة بصلاحيات البرلمان بما فيها الوظيفة التشريعية، ومن خلال بحثنا هذا حاولنا ابراز الدور التشريعي لمجلس الأمة الجزائري. لقد عمل المؤسس الدستوري على تدعيم العمل التشريعي للبرلمان وترقيته، مما أدى إلى إنشاء مجلس الأمة، وجعله يتمتع "باستقلالية " على المستويين العضوي والوظيفي.و بموجب التعديلات الدستورية سنة 2016 تعزز الدور التشريعي للمجلس، إلا أن مسألة ممارسة مجلس الأمة لسلطته في التشريع ما زالت تواجهمجموعة من العقبات من بينها السلطات المحدودة جدا المخولة له. لذا نرى من الضروري القيام بتغييرات عميقة في هذا الشأن لتمكين مجلس الأمة من ممارسة سلطاته التشريعية بكل استقلالية، و ذلك من شأنه أن يمكنالغرفة الثانية للبرلمانمن المساهمةالحقيقية في ترقية العمل التشريعي البرلماني. الكلمات المفتاحية: مجلس الأمة- العمل البرلماني- التعديل الدستوري- سلطة التشريع. Abstract : The Council of the Algerian Nation, which was created under the Constitution of November 28, 1996, is a legislative institution that embodies the two-chamber system in the Algerian Parliament. This institution should have the powers of Parliament, including the legislative function. The constitutional founder worked to strengthen the legislative work of the parliament and its promotion, which led to the establishment of the Council of the Nation, making it "independent" at both the organic and the functional level. However, the question of the exercise by the Council of the Algerian Nation of its authority in legislation has been limited by a number of obstacles, including the very limited powers vested in it. Therefore, it is necessary to make profound changes in this regard in order to rehabilitate the Council of the Nation in order to enable it to exercise its legislative powers independently, to close the gates to the executive authority, which would make the Council of the Nation really contribute to the promotion of parliamentary legislative action.
