مقاماتُ التَّشريع النبويّ -عند الإمام محمد الطاهر بن عاشور- وأثرُها في الاجتهاد The Status Of Prophetic Legislations - At The Savant Mohamed Tahir Ben Achour - And Its Impact On Diligence Process

الملخص
إن الاكتفاء بظاهر الخطاب - مهما استُنفذت دلالاتُ لفظه- ليس بكاف في القطع بمقصد المتكلم ومدلول خطابه، حتى ينضاف إليه اعتبارُ ما يحفُّ بالكلام من القرائن الحاليّة والمقاليّة، التي تعين المجتهد وتسدده في الاستنباط؛ وخطاب الشّرع من أهمِّ وأخطر الخطابات التي يجب فيها مراعاة تلكم الأحوال والمقامات. ولقد أبدع العلامة محمد الظاهر ابن عاشور في تتبُّع مقاماتِ التَّشريعِ النَّبويِّ وأحوال تصرفات النبيِّ ﷺ التشريعية، كما يظهر ذلك جليا في هذه الدراسة؛ فجاء هذا البحث لبيان تلك المقامات وترتيبها عند الإمام، وتجلية أثرها في توجيه الاجتهاد، بما يفيد المجتهدَ ويعينُه على ملاحظة حقيقة تلكم الأقوال والتصرفات؛ فيصدر في اجتهاده على منهج استنباط أصيل ومتكامل؛ فانتظم البحث ثلاثة مطالب: الأول منها: لمقامات التشريع النبوي الملزمة، والثاني: لمقامات التشريع النبوي غير الملزمة، وجاء المطلب الثالث: لإبراز أهميَّة استحضار تلك المقامات في عملية الاجتهاد، وختم البحث بأهم النتائج الحاصلة من الدراسة. ABSTRACT The appearance of the word meaning is not enough to attain and express the deep signification of the intention talking ; even we use an exhausted word semantics ; the real sense can be covered with the using the current spouse surrounds , The legislator speech is consider as the most important instance when the specialist have to take a particular care to the speech status in the aim to support the study and deduction process the savant Mohamed Zahir Ben Achour follow up with innovation maqamat prophetic legislation and actions of the Prophet ﷺ legislature, as reflected in the study; the present research is coming highlight those status and arrange them ; as well as clarify the impact in the diligence revising methodology, which assist the scientists to give sentences based on an integrated and genuine approach the Search enclose ; three demands: first to the maqams of prophetic mandatory legislation and second prophetic non-mandatory legislation maqamat, the third requirement to accentuate the importance to integrate the maqamat in the diligence process , and sealing the main research results obtained from the study.
